A.      TERMS AND AGREEMENT

 

This is a legal agreement. By accessing this web site or using any service provided herein, you accept and agree to be bound by all the terms and conditions of this agreement. Please read this entire agreement carefully before accepting its terms.

General terms and conditions

1. Parties of this Agreement are:

(a) A visitor / user to this web site ("YOU").  "You" means Your Company, its officers, members, agents, if the user is acting on behalf of other persons or company.

(b) OPERA TRAVEL (Trade name of AnD Opera Travel Ltd), the owner and operator of this website.  All references to "US", "this website" or "this site" shall be construed to mean OPERA TRAVEL (Trade name of AnD Opera Travel Ltd).

2. Assent to Terms of Use and Amendment: OPERA TRAVEL (Trade name of AnD Opera Travel Ltd) grants a non-exclusive, non-transferable, and revocable license to You and provides the services available at this site to You subject to the following terms and conditions. We may amend these terms and conditions from time to time without notice to you. You can review the most current version of the terms and conditions at any time at www.opera-travel.com. In addition, when using particular services in this site, guidelines or rules may be posted which are applicable to your use of those services. Your use of this site and your relationship with www.opera-travel.com   are subject to all guidelines or rules that may be posted from time to time on the site, which are all incorporated by reference into this agreement. By using this site, you are agreeing to be bound by all of the terms and conditions of the most current version of the user agreement and any guidelines and rules posted on this site. If you do not agree to be bound by this agreement, do not use this site.

3. Entire Agreement: This "TERMS OF USE" Agreement will be expressly incorporated by reference in each and every agreement between You and OPERA TRAVEL (AnD Opera Travel Ltd) It supersedes any and all prior and existing agreements, whether oral or in writing, between You and  OPERA TRAVEL (AnD Opera Travel Ltd)   with respect to the subjects addressed in this "TERMS OF USE" Agreement and constitutes the entire agreement between the parties with respect to those subjects.

4. Prohibited Conduct: You agree (i) not to use this site to upload or distribute in any way files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; (ii) not to interfere or disrupt this site or any networks connected to this site; (iii)not to use any device, software or routine or attempt to interfere with the proper functioning of this site or any transactions being offered at this site; (iv) not to take any action that imposes an unreasonable or disproportionately large load on OPERA TRAVEL (AnD Opera Travel Ltd)'s infrastructure; (v) not to use this site to collect or harvest personal information, including, without limitation, financial information, about other participants at this site; and (vi) not to impersonate any person or entity or falsely state or otherwise misrepresent Your affiliation with a person or entity. You agree not to use the services, products, or downloads available at this site for illegal purposes, and to comply with all regulations, policies and procedures of networks connected to this site.

5. Compliance with Laws: You shall comply with all applicable laws and regulations of the Republic of Cyprus (e-Commerce Law: L156(I)/2004 and Amendment Law: L97(I)/2007 & CTO Travel Agencies - Laws/Regulations/Guidelines)  and foreign authorities relating to any service, product, or download associated with this site

6. Registration Data and Privacy: Registration may be required for you to download content from this site, or for your participation in certain services offered at this site. You must provide certain current, complete, and accurate information about You as prompted to do so by the New user registration form and maintain and update such registration information as required to keep such information current, complete and accurate. You warrant that such data is accurate and current, and that you are authorized to provide such data. You authorize us to verify such data at any time. If any registration data that You provide is untrue, inaccurate, not current or incomplete, OPERA TRAVEL (AnD Opera Travel Ltd)   retains the right, in its sole discretion, to suspend or terminate rights to use the services. Registration Data and certain other information about you are subject to our Privacy Policy, which may be accessed from the www.opera-travel.com online bookings page. Solely to enable OPERA TRAVEL (AnD Opera Travel Ltd) to use information You supply us internally, so that we are not violating any rights You might have in that information, You grant to OPERA TRAVEL (AnD Opera Travel Ltd) a nonexclusive license to  convert such information into digital format such that it can be read, utilized and displayed by OPERA TRAVEL (AnD Opera Travel Ltd) computers or any other technology currently in existence or hereafter developed capable of utilizing digital information. 

7. Age and Responsibility: You represent that You are of sufficient legal age to create binding legal obligations and to be responsible for any contractual and/or financial liabilities that You may incur as a result of the use of this web site. You understand that You are financially responsible for all uses of this web site by You and/or those using your login name and password. Should You have lost or become aware that an unauthorized person may have access to your login name and/or password, contact us immediately.

8. Limited warranties: Whilst we endeavor to ensure that the information on this website [(excluding user content)] is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date. To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

9. Limitations of liability: Nothing in these terms and conditions (or elsewhere on our website) will exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law. Subject to this, our liability to you in relation to the use of our website or under or in connection with these terms and conditions, whether in contract, tort (including negligence) or otherwise, will be limited as follows:

(a) to the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature;]

(b) We will not be liable for any consequential, indirect or special loss or damage;

(c) We will not be liable for any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information;

(d) We will not be liable for any loss or damage arising out of any event or events beyond our reasonable control;

(e) Our maximum liability in relation to any event or series of related events will be limited to 1000 euro.

10. Indemnity: You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms and conditions, [or arising out of any claim that you have breached any provision of these terms and conditions].

11. Breaches of these terms and conditions: Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

12. Assignment: We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

13. You Order: Our system will save your bookings in your Member Account, where you will be able to review and check your current and old bookings as often as you like.

14. Severability: If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

15. Exclusion of third party rights: These terms and conditions are for the benefit of you and us, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms and conditions is not subject to the consent of any third party.

16. Entire agreement: These terms and conditions constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website. Any record you may require in relation to services purchased through our website may be available to you upon request. You may contact our office for further assistance. At the moment all references are kept in our back-office for accounting purposes and for future reference.

17. Law and jurisdiction: These terms and conditions will be governed by and construed in accordance with Cypriot law, and any disputes relating to these terms and conditions will be subject to the [non-]exclusive jurisdiction of the courts of Cyprus.

18.  Language: For the moment all information is in English. Any contract that may need to be completed or reservation form and/or any enquiry will be in English. Upon request, we may apply the Greek language in certain fields, such as correspondence and communication with our office. Most importantly, at the time of reservation – all names must be entered in English Capital letters, as they appear on your travel documents – Passports and Identity Cards where applicable.

19. Changes and Cancellations after payments:  Up to 14 days after   the on line payment of your flights, hotel or excursion package, if you wish you can cancel or amend your reservation. You can   submit your written request to info@opera-travel.com.

 Any ticket or hotel change or cancellation suggests an extra services charge of 10 Euros from our company, which is separate from any kind of fees or penalties imposed by the supplier (airline/ hotel).

Any changes or cancelation for excursions packages are subject to the following cancellation charges.  All cancellations made more than 30 days prior to departure will incur the cancellation charge of EUR 10.00 per person.  All cancellations made within the period of 30 to 14 days prior to departure will incur a cancellation charge of 30% of the total excursion cost. ·All cancellations made within 14 days prior to departure are fully non-refundable and will incur a cancellation charge of 100% of the total of the excursion cost.

B.      TERMS AND CONDITIONS

1.       FLIGHT BOOKINGS  -  TERMS AND CONDITIONS: 

-Flight Booking Steps:

1.    Search to show flights.

2.    Select and the option you prefer (book this flight).

3.    Proceed to booking,

-Before you proceed to booking check flight details and open fare rules.

-Read the fare rules especially cancellation and changes policy

-If you have not already registered, please complete your registration, (see registration steps),if you are registered, please sign in.

4.    Confirm your booking,

-Enter traveller’s details as written on the passport or ID (surname / name / date of birth).

- Agree with term and conditions and confirm.

-Your reservation is confirmed and you will receive an email.

5.    Pay on line and you will receive your ticket by email.

Air transportation is subject to the individual terms of the individual air carriers, which are incorporated herein by reference and made part of the contract of carriage. Before you proceed to booking open fare rules and read them carefully, especially cancellation and changes policy. Incorporated terms may include, but are not limited to: Liability limitations for personal injury or death, Baggage liability limitations, Overbooking of flights and compensation schemes, The right of the carriers to change the terms of the contract, The right of the carriers to change schedules without notice, Rules on reconfirmation, check-in times.

You have the right to inspect the full text of each carrier's applicable terms at its airport and city ticket offices.

Passenger shall comply with Government requirements, present exit, entry and other required documents and arrive at the airport by the time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.

SERCH AND AVAILABILITY : Enter airports (from / to), number of persons , and dates and you get the available flights sorted  by price.

PRICES: All prices are inclusive of the base fare, the applicable taxes and our service fee. Prices are in Euro (EUR) unless otherwise provided and are accurate at the time of booking. If taxes, fees or charges are introduced or increased the cost of the flight may be increased to cover this. Once the full price has been paid and tickets have been issued we will not increase the price to be paid by You unless the carrier also increases the price of your flight. In this case we reserve the right to pass the additional cost to You.

FARE RULES AND REGULATIONS:  The passenger is advised of all important fare rules and regulations. Special attention should be paid to the so-called "low cost" fares and/or special offers, which are accompanied by substantial restrictions according to each carrier's tariff

NON-REF: This rule means that the fare is not refundable under any circumstances. In case the very same traveller does not travel on the exact dates and flights indicated he/she cannot obtain a refund for the said fare. Such fares (tickets) are also not transferable to other travellers.

CHECK RULE FOR CHANGE/CANCEL RESTRICTIONS: According to the carrier's fare rules and regulations any name and/or flight and/or date changes and/or cancellations/amendments are restricted.

PAYMENT AND TICKETING MUST BE MADE WITHIN 1 TO 72 HOURS OF RESERVATION: The issue of ticket(s) and the payment must be made within a certain time frame from the time the reservation was made. We shall not accept your booking unless full payment is made. Payment can be done by Visa and Master debit or credit cards though the secure JCC Gateway system. A purchase with the name OPERA TRAVEL  will appear in your bank statement. Cash and cheque options are possible to individuals and/or Travel Agents when affecting a booking and payment in person at our offices. Such cheque payments are subject to clearance through our Bank. Payments by special agreement are reserved for pre authorized accounts and/or Travel Agents. Following payment we shall process your booking and advise You accordingly. In case of non-availability we shall recommend alternative options and if not accepted by You we will refund the amount paid by You immediately.

GROUPS: For a group of 10 or more passengers please send your request through our site or call us.

CANCELLATIONS AND/OR AMENDMENTS: If after a confirmation has been given You wish to cancel or change your flight arrangements in any way, including name changes, we will do our utmost to effect the changes, to the extent permitted by each carrier's fare rules and regulations. In all such cases, it is mandatory to receive your written request through our site, or by post, fax or e-mail.

CHANGES BY US: There may be occasional and valid reasons, in most cases beyond our control, when changes have to be made and we reserve the explicit right to do so. We will do our utmost to notify You of these changes as soon as they are received by the carrier. If the change is a major one, such as (a) change in the departure time of over 12 hours or (b) change in the departure or arrival airport, we will let You know as soon as possible. In such cases, and to the extent permitted by each carrier, You may accept the change as notified, select an alternative flight and/or cancel your booking and get full refund.

FORCE MAJEURE: We will not be liable for any changes caused by natural disasters, threats of war, weather conditions, industrial or labour disputes or any similar event(s) beyond our control.

FLIGHT DETAILS: There are occasions when delays may occur. It is your responsibility to reconfirm your flight, departure and return dates and times. In the case of delays announced after You have checked in, most airlines will normally offer the following arrangements:

• Between 4 and 6 hours : Light refreshments and/or a snack.

• Between 6 and 12 hours : A main meal.

• Over 12 hours : Overnight accommodation and overnight kit, if possible.

CHILDREN AND INFANTS: Children should be more than 2 but less than 12 years of age. Infants are less than 2 years of age. Age requirements refer to the date of return flight. The system will advise the correct fare for children and/or infants provided a date of birth has been specified.

UNACCOMPANIED MINORS: Carriers normally require special conditions for the transportation of unaccompanied minors (children) and sometimes may apply a surcharge. In such cases an Unaccompanied Minor's Form needs to be completed and signed by the parent or guardian. In addition a recipient adult relative needs to receive the unaccompanied minor at the arrival airport. Please contact us or speak the carrier direct for such cases.

CLAIMS: All claims involving air travel or baggage claims should be addressed to the carrier and not to us.

CONFIRMATION, TICKETS, E-TICKETS AND/OR FLIGHT VOUCHERS: When You book a flight through this site You will receive an immediate confirmation in the form of a Passenger Name Record (PNR). Subject to carriers' restrictions, rules and regulations regarding the booking of seats and issuance of tickets, you shall arrange the payment on line by credit card and issue the tickets within 1 hour to 72 hours as stated on the confirmation email otherwise your booking will be cancelled. When you pay and issue for your booking, applicable, electronic tickets (e-tickets) or flight vouchers will be sent to the e-mail address provided to us. If applicable You must print the e-ticket(s) or Flight Voucher(s) delivered to the e-mail address provided to and present same to the carrier at the airport of departure. In case of printing trouble please contact us immediately for corrective action. A purchase with the name OPERA TRAVEL  will appear in your bank statement.

2.       HOTEL ACCOMMODATION BOOKING TERMS AND CONDITIONS:

CHECK-IN AND CHECK-OUT: Hotel accommodation prices reflect a 24-hour occupancy of the chosen accommodation. Check-in and check-out times vary from country to country but normal check-in times are between 1 to 2 p.m. whilst check-out times are between 10 to 12 a.m. Earlier check-in or later check-out is possible at the absolute discretion of the accommodation establishment, at an extra cost and subject to availability at the time of confirming booking.

STARS OR CLASS CATEGORY CLASSIFICATIONS: Star ratings and/or class category classifications may vary in quality from country to country and, therefore, cannot be relied upon to identify the quality of the accommodation establishment. A detailed description of each accommodation establishment, including photos (if applicable), is provided by the system for your review and check prior to booking and payment.

CLAIMS: All claims involving hotel accommodation should be addressed to the local management of the hotel establishment for immediate rectification.

CANCELLATIONS AND/OR AMENDMENTS: If after a confirmation has been given You wish to amend your accommodation arrangements You must submit a written request to us. We shall do our utmost to effect the change(s) but this is dependent on restrictions set forth by the accommodation establishments, and may attract a penalty or cancellation fee or the revised accommodation arrangements may cause an increase in costs.

CHANGES BY US: here may be occasional and valid reasons, in most cases beyond our control, when changes have to be made and we reserve the explicit right to do so. In such cases or in the event of a confirmed booking becoming unavailable, for reasons beyond our control, we will do our utmost to notify You as soon this information is received from the supplier. We shall also endeavor to offer alternative accommodation of similar or higher standard at the same location. A full refund will be made immediately to your account if such alternative accommodation is not accepted by You.

FORCE MAJEURE: We will not be liable for any changes caused by natural disasters, threats of war, weather conditions, industrial or labour disputes or any similar event(s) beyond our control.

BOOKINGS: We accept all bookings made at least 72 hours (or more) prior to the check-in date.

CONFIRMATION AND ACCOMMODATION VOUCHERS: When you book a hotel through this site You will receive an immediate confirmation email with all details of your booking and cancellation dead line. Within 1 hour to 72 hours as stated on the confirmation email you shall arrange the payment on line by credit card and reconfirm the reservation otherwise your booking will be cancelled. When you pay and reconfirm your booking, applicable hotel vouchers will be sent to the e-mail address provided to us. If applicable You must print the Voucher and present to the hotel on check in. In case of printing trouble please contact us immediately for corrective action. A purchase with the name OPERA TRAVEL  will appear in your bank statement.

3.       PACKAGE BOOKINGS  -  TERMS AND CONDITIONS

- Agree with terms / conditions and confirm.

-Your reservation is confirmed and you will receive an email.

5.    Pay on line and you will receive your voucher by email.

SERCH AND AVAILABILITY : Enter number of persons , and dates and you get the available packages sorted  by price.

PRICES: All prices are in Euro (EUR) unless otherwise provided and inclusive of applicable taxes. Prices are quoted (unless otherwise provided) to cover air transportation, if applicable (unless otherwise provided), hotel accommodation, specified meals, tour guide & sightseeing tours (if applicable) and land transfers(if applicable), for each variation selected on a per person basis, as specified in each Tour Operators Brochure (provided by the system). Prices are accurate at the time of booking. If taxes, fees or charges are introduced or increased the cost of the excursion may be increased to cover this. Once the full price has been paid and the Excursion Vouchers have been issued we will not increase the price to be paid by You unless the Tour Operator who organizes and supplies the excursion also increases the price of the said excursion. In this case we reserve the right to pass the additional cost onto You.

DEPARTURE AND ARRIVAL DATES: On the Excursion Brochure (provided by the system) of each Tour Operator the departure and arrival times are specified in detail. You and all members of your party have to follow the specified schedule/program of the excursion booked. Failure to do so does not give you the right to claim for unused services.

PACKAGE DESCRIPTION: Every effort has been made to provide accurate information, including photographs of all excursion services featured on our site or supplied through our site. In certain cases information and photographs provided by the Tour Operators may differ from actual. All such information is provided by the Tour Operators. We endeavour to feature excursion services of commonly acceptable standards but we are not liable for any misrepresentation in the accuracy of information, descriptions or photographs supplied by third parties. In certain cases circumstances may necessitate changes or deviations from the excursion program. All schedules, itinerary destinations, hours of arrival and departure, hotel and/or land transfers, sightseeing tours and other components of the excursion program are subject to change without prior notice and without reference to us by the Tour Operators. If such eventuality materially affects Your enjoyment, it is in both our interests for You to advise the management of the Tour Operator immediately, get a written report from the management and if corrective action is not taken or your complaint is not dealt with during Your excursion, contact us upon your return for a complaint follow up.

CLAIMS: All claims involving the excursion should be addressed to the Tour Operator for immediate rectification.

TRAVEL DOCUMENTS( passports, visas, health requirements, etc.): Each country has its own entry and exit requirements. It is your responsibility to make sure that You and the members of your party have and carry with them all valid travel documents, as necessary.

INSURANCE: Adequate insurance cover may exist from insurance companies according to each insurance program's contract (i.e.,medical expenses, personal injuries, theft, etc.) Through our Other Services module You may book and purchase on line one of our insurance programs. We strongly recommend that You and all members of your party are adequately insured as soon as You make a flight booking.

Cash and cheque options are possible to individuals and/or Travel Agents when affecting a booking and payment in person at our offices. Such cheque payments are subject to clearance through our Bank. Payments by special agreement are reserved for pre authorized accounts and/or Travel Agents. Following payment we shall process your booking and advise You accordingly. In case of non-availability we shall recommend alternative options and if not accepted by You we will refund the amount paid by You immediately.

CANCELLATIONS AND/OR AMENDMENTS: If after a confirmation has been given You wish to amend Your excursion arrangements You must submit a written request to us. We shall do our utmost to effect the change(s) but this is dependent on restrictions set forth by the Tour Operator involved, and may attract a penalty or cancellation fee or the revised excursion arrangements may cause an increase in costs.

CHANGES BY US: There may be occasional and valid reasons, in most cases beyond our control, when changes have to be made and we reserve the explicit right to do so. In such cases or In the event of a confirmed booking becoming unavailable, for reasons beyond our control, we will do our utmost to notify You as soon as this information is received by the Tour Operator. We shall also endeavor to offer alternative excursion of similar duration and to the same or similar destination. A full refund will be made immediately to your account if such alternative excursion is not accepted by You.

FORCE MAJEURE: We will not be liable for any changes caused by natural disasters, threats of war, weather conditions, industrial or labour disputes or any similar event(s) beyond our control.

BOOKINGS: We accept all bookings made at least 72 hours (or more) prior to the departure date.

CONFIRMATION AND PACKAGE VOUCHERS:When you book a package through this site You will receive an immediate confirmation email with all details of your booking and cancelation dead line and payment plan. Within 1 day to 7 days as stated on the confirmation email you shall arrange the payment of the deposit on line by credit card and reconfirm the reservation otherwise your booking will be cancelled.  When you settle your booking, applicable package vouchers will be sent to the e-mail address provided to us. If applicable You must print the Voucher and present it to the Tour Operator Guide at the airport of departure (if applicable) or to the Tour Operator Guide at the point of departure. In case of trouble when printing the Package Voucher(s) please contact us immediately for corrective action. A purchase with the name OPERA TRAVEL  will appear in your bank statement.
